CAB's response to remarks made by Hon Audrey Eu

In response to the remarks made by the Hon Audrey Eu in her "Letter to Hong Kong" broadcast on RTHK today (June 17), a spokesman for the Constitutional Affairs Bureau said, " The Hong Kong SAR Government is established according to the Basic Law, the relevant systems have constitutional basis.

"Hong Kong's rule of law has a firm foundation. According to the Basic Law, the Court of Final Appeal has the power of final adjudication over all court cases. Thus, the common law system can be maintained. The power of final interpretation held by the Standing Committee of the National People's Congress regarding the Basic Law is part of Hong Kong's rule of law. Interpretations made by the Committee will not affect adjudications already given by the Court of Final Appeal over court cases.

"The Chief Executive has made it clear that the third term HKSAR Government will cooperate with any political party which is prepared to support his election manifesto. This is an entirely reasonable and practical approach to adopt," he said.
